SelfBack ApS (referred to as “SelfBack”, “we” or “us” in this document), offers a self management platform, in the form of a mobile application, to persons with non-specific low back pain. All persons using SelfBack and it’s content (referred to as “Services”) are known as “Users”.

These Terms of Use (referred to as “Terms” throughout this document) govern your access to and use of our services, which are required to be accepted before using our Services. Please read the Terms and Conditions before using our Services, as they are considered a legally binding contract between you and SelfBack.

By using our Services you are considered to have read and accepted these Terms and Conditions, together with our Privacy Policy. Should you not agree with any part of these Terms, you should not use our Services and should immediately terminate your use of SelfBack.

Use of Selfback Services

(A) Who can use SelfBack

In order to use SelfBack, you must be at least eighteen (18) years old. Those under this age limit may not use any Services provided by SelfBack.

(B) Your Account

You will need to create a SelfBack account in order to gain access to the Services provided by SelfBack. It’s important that all information given during account creation is accurate and reflects your current condition, in order for the Services to be working as intended and advertised.

During account creation you will be asked to verify your phone number, as it will be used for verifying your identity in the future, when logging in to our Services. If you do not verify your phone number you will not be able to access and use our Services.

(C) Activation Code & License

In order to create your SelfBack account, you will need an activation code, which will be provided by your health care professional, such as a clinic or any other pathway which focuses on rehabilitation or prevention of non-specific low back pain.

The activation code itself grants access to the use of our Services for a specific amount of time, dependent on the distributor of the activation code. When the license duration has expired, access to our Services will be limited, after which the redemption of a new activation code will be required, in order to gain full access to our Services again.

Should the time that your account has been without an active license exceed 2 years, then your account will be deleted, following the Terms describing the Account Inactivity.

(E) Deleting your account

You always have the right to have your account deleted, which you can do directly within SelfBack, through accessing the “Account” page under the “Settings” section within the “Profile” page. As part of the account deletion, you will need to verify it through entering a confirmation code sent to the phone number you verified during account creation.

Deleting your account will delete all information related to your account, such as health information, progression data and all progress and rewards obtained while using our Services. It will not be possible to restore your account after you have deleted it, neither by customer support or through any other means.

(F) Account Inactivity

If your account has not been active within our Services within the last two years, then it will be deactivated and deleted, erasing all information that has been tied to your account. You can always create a new account with the same credentials, should you wish to do so.

(G) Updates & Changes to Service

There might occur changes to our Services throughout your use of it, as we continuously improve our Services, in order to offer a better experience for our users. In connection with changes there might be added new functionalities and features, however some features of the Services might be restricted or removed. All changes may happen without notice.

Some changes to the Services might require updates, and won’t function as advertised if the updates are not installed. All updates will be available through the App Store or Google Play Store, and we recommend that you have enabled automatic updates, in order to always stay up to date with any changes to our Services.

Privacy

(A)

All information about how we collect, store and use your Personal Data, can be found in our Privacy Policy. Through having accepted our Privacy Policy and these Terms, you have given consent to collect the required data in order for SelfBacks Services to function as advertised.

(B) Ownership of Data

We believe that the user is the owner of their data. Your data will never be available for anyone else than us, unless you explicitly have given us permission to do so.

Mobile Services

Our goal is to make our applications available on as many platforms as possible, however we can’t guarantee that our applications are compatible with your device. Should your device not be supported, or you experience any issues, then please contact support@selfback.dk and we will try to help you.

If you use our applications, your standard data and messaging rates will apply, and the rules of the app store from which you are downloading will also apply.

(A) App Stores

SelfBack is only available through the official app stores (the “App Provider”) and will never be distributed by any other means. If you have downloaded SelfBack through any other method than the App Provider, then it’s highly recommended that it’s uninstalled imeditialy and the version offered by the App Provider is downloaded instead.

You must also comply with all applicable third-party terms of service, such as those required by the App Provider, when using our application.

Safe use of SelfBack

(A) Intended use of SelfBack

SelfBack is intended to be used by users that suffer from non-specific low back pain, as a supplement to their treatment.

YOU MUST ONLY USE THE APP AFTER YOU HAVE CONSULTED WITH A HEALTH PROFESSIONAL AND AFTER YOUR HEALTH PROFESSIONAL HAS APPROVED THAT YOUR DIAGNOSIS ARE SUITABLE FOR THE TREATMENT THAT IS OFFERED WITHIN THE APP ITSELF.

A health professional is, but not limited to, a physiotherapist, chiropractor or general practitioner. If you are in doubt who can advise you about your pain, consult your general practitioner.

Should you have any health-related issues, please contact or visit your doctor or other healthcare professionals immediately, as we will not be able to help with matters within this area. In the case of an emergency, please call your doctor or nearest hospital service immediately.

(B) Safety

You should consult your healthcare professional and consider the associated risks before using our Services. All content within our Services has been developed to comply with all safety standards, ensuring the best possible foundation for safe use.

By using our Services, you agree and warrant that you have received the consent of your physician to perform the type of exercises made available to you through the use of our Services, and that your healthcare professional has given you a diagnosis that makes you suitable for the treatment offered by our Services.

Throughout your daily use of our Services, it is very important that you are aware of your pain signals during and outside of the exercises. You should always consult a healthcare professional if you experience the slightest doubt in regards to how to respond to your pain in your daily life or your pain while exercising with the app.

To the maximum extent permitted by applicable law, we are not responsible or liable, directly or indirectly, for any damage caused by your physical activities or your use or inability to use our Services or features of our Services.

(C) Exercise Program

Your personal exercise program made available within our Services, is based on the data we collect, throughout your usage of our Services (read more about this under our Privacy Policy). Based on the collected data, SelfBack compiles a training program consisting of exercises and educational content, tailored towards your specific condition and needs.

(D) General Information

The app also provides general information about low back pain and how to manage it on a daily basis, offering advice and tips to. This information should not be taken as a substitute for healthcare advice, but should be regarded as helpful general information.

Changes to the Terms

When changes to the Services are made, there might be a need to update these Terms, such as making changes or additions to it.

Whenever changes are made that have an impact on you as a User of our Services, you will be asked to review and agree to the updated version of the Terms. Should you not agree to the updated Terms, your access to the Services covered by the specific Terms will be limited or removed, until the updated Terms have been agreed.

Warranties

EXCEPT WHERE PROHIBITED BY LAW, SELFBACK EXPRESSLY DISCLAIMS ALL WARRANTIES, REPRESENTATIONS AND GUARANTEES OF ANY KIND, WHETHER ORAL OR WRITTEN, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT TO THE FULLEST EXTENT PERMISSIBLE UNDER THE LAW. THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS BASIS.

Without limiting the foregoing, you understand that, to the maximum extent permitted by applicable law, we make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness or reliability of any of the Services or any Content. To the maximum extent permitted by applicable law, we do not warrant that (I) the Services will meet your requirements, (II) the operation of the Services will be uninterrupted (III) errors will be corrected. Any oral or written advice provided by our agents or us does not and will not create any warranty. To the maximum extent permitted by applicable law, we also make no representations or warranties of any kind with respect to Content.

No advice or information, whether oral or written, obtained from the Services, will create any warranty not expressly made herein. You therefore expressly acknowledge and agree that use of the Services is at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy and effort is with you.

Limitation of Liability

We are building the best Services we can for you but we can't promise that they will be perfect. We are not liable for various things that could go wrong as a result of your use of the Services.

To the maximum extent permitted by applicable law, under no circumstances (including, without limitation, negligence) shall SelfBack, its subsidiaries or partners be liable to you or any third party for (I) any indirect, incidental, special, reliance, exemplary, punitive, or consequential damages of any kind whatsoever; (II) damages relating to your access to, use of, or inability to access or use the Services.

In particular, to the extent permitted by applicable law, we are not liable for any claims arising out of (III) your use of the Services (including but not limited to your participation in any activities promoted by or accessed via the Services), (IV) the use, disclosure, display, or maintenance of an user’s personal data, (V) other content or information, services or goods received through or advertised on the Services
